Terms of Use

These Terms of Use govern your use of the Tide Chart & Fishing Times app ("Tide Chart", "the app"), published by an individual developer trading as Kraus ("we", "us"). By downloading or using the app, you agree to these terms.
1. What the app does
Tide Chart displays tide predictions for public tide stations, together with derived information such as solunar bite windows, sunrise and sunset times, and moon phase. It is a planning and information tool for recreational use.
2. Not for navigation or safety decisions
Tide Chart is not a navigation instrument and must not be relied on for safety. Do not use it to determine clearance under a keel or a bridge, to plan a passage, to judge whether a bar, channel or sandbank is safe to cross, or for any other decision where an error could cause injury, death, or damage.
Tide predictions are astronomical calculations. They do not account for wind, barometric pressure, storm surge, river discharge, seiche, or local conditions, and the actual water level can differ substantially from the prediction. Always use official nautical charts, tide tables and notices to mariners, and use your own judgement on the water.
3. Data sources
Tide predictions are retrieved from the public API of the NOAA Center for Operational Oceanographic Products and Services (CO-OPS). We do not generate, verify or guarantee that data, and it may be delayed, incomplete, revised or unavailable. Tide Chart is not affiliated with, endorsed by, or sponsored by NOAA or the United States government.
Bite windows, day ratings and similar features are derived estimates based on moon and tide timing. They are entertainment and planning aids, not predictions of fish behaviour, and no catch is implied or guaranteed.
4. No account
Tide Chart does not require an account. Your spots, settings and cached predictions are stored on your device, as described in our Privacy Policy.
5. Paid access
Tide Chart is a paid app. Using it requires a purchase through the App Store, which you make from within the app. Depending on the option you choose, access is granted either as an auto-renewing subscription or as a one-time purchase.
The options available to you, their prices, their terms, and any introductory offer are shown in the app in your local currency before you confirm a purchase. Prices may differ by country and may change for future purchase or renewal periods.
6. Auto-renewing subscriptions
If you choose a subscription, payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically for the same period unless it is cancelled at least 24 hours before the end of the current period, and your Apple Account is charged for the renewal within 24 hours before the period ends.
You can manage or cancel your subscription in the App Store settings of your Apple Account at any time. Cancelling stops the next renewal; it does not retroactively refund the current period.
Where an introductory offer or a free period is available, it is offered once per Apple Account and per subscription group, and eligibility is determined by Apple. Unless it is cancelled at least 24 hours before the free period ends, it converts into a paid subscription at the price shown to you when you signed up. Any unused part of a free period is forfeited if you buy a subscription before it expires.
7. One-time purchase
If you choose a one-time purchase, it is charged once to your Apple Account, does not renew, and is not billed again. It is tied to the Apple Account used at the time of purchase.
8. Restoring purchases
If you reinstall the app or move to another device signed in with the same Apple Account, use "Restore Purchases" in the app to restore an active subscription or a previous one-time purchase.
9. Refunds
Purchases are processed by Apple. Refunds are handled by Apple under its own policies and terms, and we cannot issue them directly. Requests can be made through Apple's "Report a Problem" page. Statutory withdrawal and consumer rights that apply where you live are unaffected by this section.
10. Changes to what is included
We may add features, change them, or remove them, including for existing users, where that is reasonable and lawful. If a change materially reduces what your purchase provides, you may cancel a subscription as described in Section 6, and statutory remedies for a one-time purchase are unaffected.
11. Acceptable use
You agree not to reverse engineer, decompile, or tamper with the app except where that right cannot lawfully be restricted, not to use it to build a competing dataset by automated bulk requests, and not to use it unlawfully or in a way that interferes with its operation or with NOAA's services.
12. Intellectual property
The app, its name, its interface, its icons and its design are ours and are licensed to you, not sold. Tide data obtained from NOAA remains subject to the terms under which NOAA publishes it. Apple, App Store and iOS are trademarks of Apple Inc.
13. Availability
Features that depend on the network, on NOAA, on Apple, or on a third-party provider may be unavailable or degraded at times. We do not guarantee uninterrupted availability or that the app will be free of errors.
14. Disclaimer and liability
Except where the law does not allow it, the app is provided "as is" and without warranties of any kind. We are not liable for missed tides, lost fishing time, damage to a vessel, personal injury, lost profit, or other loss arising from reliance on the app, except for liability that cannot be excluded by law, including liability for intent, gross negligence, and injury to life, body or health. Nothing in these terms limits your mandatory statutory rights as a consumer.
15. Apple
Apple is not a party to these terms and has no obligation to provide support for the app. Apple is a third-party beneficiary of these terms and may enforce them against you. Your use is also subject to the Apple Media Services Terms and Conditions.
16. Changes to these terms
We may update these terms. The current version is always published here with its "Last updated" date. Continued use of the app after an update means you accept the revised terms.
17. Governing law
These terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you use the app as a consumer, you keep the protection of the mandatory provisions of the law of your country of residence.
18. Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in force.
